Foreclosure in Nevada can be by either judicial or non-judicial process.  A judicial foreclosure is where the lender/servicer files a lawsuit and you are served with a Complaint & Summons by a process server.  A non-judicial foreclosure is where the lender/servicer records a Notice of Default with the county recorder and posts the notice upon the property in addition to mailing several copies of the notice to the homeowners. 


It is important to know that you must Answer a lawsuit or a default will be entered and judgment for a deficiency will result.  DO NOT IGNORE A COMPLAINT, even if you are working on a short sale or loan modification.  The various departments at the lender do not always communicate and you could have the home foreclosed upon.
